Terms of Service

1. Acceptance of Terms

By accessing or using the Nataris AI Inference API ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including developers, businesses, and individuals accessing the API.

2. Description of Service

Nataris provides a peer-to-peer AI inference marketplace that connects developers with distributed compute providers. The Service allows:

Developers to submit AI inference requests via API
Compute providers to process inference jobs and earn rewards
Real-time job matching based on model availability and device capabilities

3. Data Processing and Privacy (Important)

Understanding Our Decentralized Architecture: Nataris operates a peer-to-peer inference marketplace. When you submit a prompt through our API:

Your prompt is transmitted securely (TLS/HTTPS) to our backend servers
Our backend routes your request to a verified provider device
During inference, your prompt is processed on a third-party device
The response is returned to you through our secure infrastructure

Data Visibility: While we use encryption for data in transit, prompts and responses are visible to provider devices during the inference process. Providers are contractually obligated not to store, log, or share any data, but we cannot provide technical guarantees equivalent to centralized cloud providers.

Recommended Usage:

Suitable for: General AI tasks, non-sensitive content, development/testing, creative applications
Not recommended for: Personal Identifiable Information (PII), protected health information (PHI), financial data, trade secrets, or other confidential information

By using our Service, you acknowledge this data processing model and agree not to submit content that would be harmful if accessed by third parties.

Verified Provider Routing (Optional): We offer optional routing to providers with verified device integrity. When using privacyLevel: "verified" in your API requests, jobs are routed only to providers who have passed device attestation checks. This reduces risk from modified apps or rooted devices, but does not eliminate the visibility of data to the device operator. Verified routing may have reduced availability and different pricing.

4. Account Registration

To use the Service, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials and API keys
Notify us immediately of any unauthorized access
Be at least 18 years old or the age of majority in your jurisdiction

5. API Usage and Limits

Your use of the API is subject to the following conditions:

Rate limits as specified in our documentation
Compliance with our Acceptable Use Policy
No circumvention of security measures or access controls
No reverse engineering or unauthorized access to our systems

6. Payments and Billing

Usage of the Service is billed based on:

Token consumption for inference requests
Current pricing as displayed in your dashboard
Pre-paid credit balance system

All payments are non-refundable except as required by applicable law or as expressly stated in these Terms.

7. Intellectual Property

You retain ownership of content you submit through the Service. By using the Service, you grant us a limited license to process your requests for the purpose of providing the Service.

We retain all rights to our platform, API, documentation, and related materials.

8. Provider Device Responsibilities

If you participate as a compute provider, you acknowledge and agree to the following:

Device Care: You are solely responsible for monitoring your device's temperature, battery health, and overall condition while running the Nataris provider app. Follow your device manufacturer's guidelines for safe charging and usage at all times.
Thermal Management: The app includes thermal warnings and may auto-pause jobs when your device reports elevated temperatures. These safeguards are advisory and do not replace your own judgment. If your device feels hot, close the app and allow it to cool.
Battery and Charging: Extended use while charging may accelerate normal battery wear. Do not leave your device unattended while charging and running inference jobs. Nataris is not responsible for battery degradation that may occur from prolonged use.
Hardware Wear: Running AI inference is a computationally intensive task. As with any intensive application, it may contribute to normal hardware wear over time. Nataris does not warrant against any device wear, performance changes, or hardware issues.
No Liability for Device Damage: To the maximum extent permitted by law, Nataris and its affiliates shall not be liable for any damage to your device, including but not limited to overheating, battery degradation, screen burn-in, storage wear, or any other hardware or software issues arising from your use of the provider app.
Personal Safety: Do not place your device on flammable surfaces or near heat sources while running inference jobs. Nataris is not responsible for any injury or property damage resulting from improper device handling or placement during use of the app.

By continuing to use the Nataris provider app, you confirm that you understand these responsibilities and accept the associated risks of running compute-intensive workloads on your personal device.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee the accuracy, completeness, or reliability of AI-generated outputs. You are responsible for validating outputs before use in any application.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATARIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or our Acceptable Use Policy. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
